It surprised me too as I'd always assumed that 'murder' had to be either pre-meditated or with intent, but while that's usually the case it very clearly isn't under 289 (5) which he 's now being charged under, which specifically covers circumstances like this.

In this case I think the Thai law's got it exactly right, as otherwise it'd be manslaughter and he'd be getting away with a lot less.
