An Australian and Thai married couple, and an American man, who were on death row in Bangkok on charges for trafficking crystal methamphetamine have all been released from prison. A report from the Sydney Morning Herald says they had been accused of smuggling half a tonne of crystal methamphetamine for the Hells Angels motorcycle gang in Thailand. I have a recurrent question related with this type of court cases:

Who is going to compensate them for all the unfair 6 years spent in a prison, and the health issues related which probably have emerged + mental depression + lack of future plans? 

They should get at least 10mil baht each + free medical support for the first 2 years.

Is this realistically going to happen?

I think they will be so grateful to be outta here that compensation will be low on their priorities. As to will they get any compensation.....

Not a snowballs chance in hell.

To receive compensation and medical care, this would need to have happened in a compassionate and progressive country. I’ll let you decide then if this is likely to happen in Thailand.

Even in countries thought to be compassionate, there are massive variations in compensation if any at all is given. I understand that in the US, if you decide you need better than a Public Defender, your free to pay for it yourself, and if acquitted, very few states will reimburse your costs. Several States have no legislation to compensate the wrongfully convicted, while others have laws disqualifying convicted felons from being able to claim, even of the conviction is totally unrelated and perhaps 30 years old,

In the UK, when calculating compensation for wrongful imprisonment, the gov is now allowed to deduct from the compensation, an element for "board and lodging", the argument being that if you were not in prison, this is a cost you would have incurred in any case. The idea that if you were free at the time, this is not the accommodation you would have chosen, carries no weight.

The compensation entails:

  • 500 baht per day of detention
  • Medical expenses (provided they don’t go over 40,000 baht)
  • Rehabilitation costs (provided they don’t go over 50,000 baht)
  • Lost income (according to the daily labour wage of each province. It should be noted that for most provinces the daily minimum wage is just over 300 baht)
  • Other expenses (provided they don’t go over 30,000 baht for legal proceedings)

However, if the person died, relatives are can claim 100,00 baht in compensation. 

….. so in reality for a westerner, jack really. And maybe receipts required. Then would his own government take a tax slice out of it?

Out of 411 people falsely  convicted none could be found to claim the compensation owed to them. Wow that was a bit convenient I think. 😁😁😁

Bet the payment went into somebody’s bank account though …. example in the news today,

Yeah that's for sure. 

As for the Bas•••••ds that have stolen the money from the disabled

Guaranteed there will be a thorough investigation ….. and well forgotten once out of media’s minds eye.

Maybe speed of forgetfulness depends on size of brown envelope as well.

Another transparent investigation that goes on forever then disappears in it's own transparency.

This is Thailand... answer = NO

So the prosecution's case was akin to: "Did you shoot at that guy across the street?"-->"No, as you can see, no weapon and zero connection with that guy"-->"But we found a guy wounded across the street, arrest him".

$10 million is a lot of money to begin with. A thorough investigation would somehow have tied the MONEY, MOTIVE, with the ACT of throwing containers overboard.  Something smells in the Land of Smiles. 

Why's everyone talking compo. 

They're guilty IMO.

Just ask yourself one question. How many Pattaya bar and guest house owners have you known with a yacht?

Something not quite right with this story of innocence.

You won’t see your typical thai vlogger living in la la land ever making vlogs about this kind of thing

Best to let sleeping dogs lie and get out of Dodge. A lot of bad stuff goes on in Pattaya and these guys and gal are lucky. Now they need to watch out for Hells Angels if they did them wrong.
