The witness saw the pickup speed up and intentionally hit the deceased.

I could be unintentional that the driver pressed the accelerator instead of break. The driver will remorse for his unintentional fault and will apologise to the deceased family. He may also become a monk soon to clear his sins and help others in a spiritual way.
