Looking at the tyre stretch mark of the pick-up truck on the road. it is obvious that the pick up truck was speeding and never maintain the recommended distance as per the highway speed limits.

THere is a common misconception among Brits that if your run into someone from behind, it is your fault.

THe real criteria is that you should be able to stop if the car in front stops abruptly. No one EVER keeps that amount of distance in normal driving conditions.

What the pick up driver will have to demonstrate is that the driving of the RR was the cause of this collision

I wonder if the RR driver is actually fully insured / licenced etc?

I also wonder why there are skid marks - surely that model pickup has ABS?

And in breaking news the owner of the pick up has shot through. Obviously not insured. Puts paid to the theory she (the roller driver) forgave him, because she didn’t wish to draw attention to her nefarious activities, which has been doing the rounds.

Hardly - He would make himself scarce either way in case she changed her mind. My guess is she "forgave" him because she thought she was in the wrong, than later someone told her that didn't matter, she had to blame the other guy.

Rear ending is normally always automatically guilty here. No ifs ands or buts unless true negligence can be proved. I know this personally from my son doing it to an uninsured ok’d woman who cut him off and slammed on the brakes because some i d i o t in front of her suddenly stopped. Only if the old lady could be proven to dart in dangerously would have maybe worked but there was no camera. 

So regardless of what the Chinese babe did, the truck is at fault as the RR was in its lane all the way. 

Why on earth is she allowed to have restaurants everywhere and who is her clientele? Chinese group tourists?

She difinitely needs to explain what she was doing stopped in the outside lane.

So you been through this in Thailand, personally huh? Well, about four months ago, I personally went through this with my son. Went to the crash scene took pictures and got my son, went to the police station - three times, and spike with our insurance agent. The insurance company, our agent requested to try to see recordings to prove that the woman was in the wrong, but in any instance, it didn’t matter because her vehicle was solidly in one lane and my son hit her from the rear and she rear ended the car in front of her, who totally stopped. 

So basically, the law is, if you rear end somebody in Thailand, you are basically automatically going to be at fault as you were following too close and that’s the law. 

Your argument and explanation are weak, and honestly the law of Thailand generally says if you rear end somebody you are at fault. Been through it.
And for any matter of fact, the Chinese woman has the right to drive in the right fast lane, so any point you’re trying to make it out the window.

The final outcome of my son’s accident was everybody was responsible for the one they rear-ended no ifs and or buts- final decision. 

And the silly thing is, it was the real fault of the first car who stopped ( fast lane), the woman who my son hit who cut in, and for my son, well, he just wasn’t paying attention good enough and going too fast.

The old lady my son hit had an old car and there was no insurance, but end result was our insurance company paid for her car, which was not more than ฿50,000 totaled.

If he was insured there’d be no need to do a runner. She never forgave him, this was made explicit in the subsequent article. Sheesh.

And that is a thin line to prove negligience even if she did abruptly cut in, and will only work if her car is partially on the line or in both lanes. Road laws here differ than our perspective countries. Thai logic.

Rear ending a vehicle makes you nearly automatically guilty, there is not much excuse and leeway

If the guy has no insurance he better sell his possessions and cough up

It has nothing to do with the accident where she was going or as to why she stopped. The owner of the truck must have been able to stop in time.

ABS brakes. How many times have I seen these being disconnected by owners

I have sympathy for her .

She has the right to sue him for a hire vehicle while her car is being repaired.

This was on Thai TV last night, showed up at the police station escorted by her lawyers, all along fully covering her face (like a murder/criminal suspect). First question at the station might have been: "Do you have a treaty with China whereby you are obligated to disclose details even for civil matters?"

Thank you for stating this. There was a particular poster who tried to contradict my original post being headstrong he was right. And here again it is looking like this poster is in fact yet again incorrect on yet another topic. I am the first one to say thank you and I stand corrected if a person points out what I said is indeed off or there is more to it than first believed..

I hope they do a full investigation on how she acquired the RR, how she acquired and how she's operating the restaurants, if the restaurants are linked to Chinese gangs, and on what kind of visa she entered and stays in Thailand.

That was one of my questions as in why so many restaurants and whom are the clientele. My guess is maybe a set up directed at Chinese tour groups. If just pointed for the normal Chinese tourist then that is not a crime as the tourist goes on their own free will.

Yes, have to agree, but she is Chinese and not sure if on the other foot sympathy and compassion is in here vocabulary and blood. If it was me having the silver spoon as such as she has, then no problem an would work out something of an arrangement that would at least slap the pickup truck driver's hand. Getting off scot-free no as I think this person was driving too fast and too close on the butt of her car. I absolutley detest Thai drivers who do this. It is my number one I HAAAAAAATE, and to me is almost time to pull over and fight.

But getting a lot cooler mellow in my older age, but even yesterday going through the airforce base in front of me an older Camry car dark tinted windows swiped drifted and hit an orange cone. I passed on my bike got ahead by a good dsitance and then I look to my right and this car's front left hood and tire was literally, and I kid you not, less than 12 inches from me and my bike trying to pass me directly. I turned and yelled WTF, the car slightly backed off and then honked at me. I instantly saw red and flipped the person off and then the car tried to chase and get me. A-Hole. I think would have hit me if could was the thought

I think it was an old Thai man who had no right to be driving. Total danger to society behind the wheel. Worst ignorant dangersou selfish drivers there are.

There are so very many thousands of A Holes on these roads.  I've never had to concentrate so much while driving then I have to do here, not even in Hong Kong and I thought that was bad enough. .

I have to admit that yesterday I was seriously thrown off guard. Worst case scenario is that this car rear ended me. I will admit I thought I was in the clear and was quickly looking to the distance to see what military aircraft were parked as I saw a small like military small 12 seater jet that was parked with some other small aircraft around it. I love airplanes and flying domestic so it just taught me again to never let my guard down. Could have ended up not in my favor. I really think it was an old thai man who had no right driving, and that would have been even when he was young. A man because of his antics. You got that right. A-Holes is correct, especially Bangkok drivers or drivers from Bangkok.

What can you say? After all, China as a country is Asian and they love nothing more than the smell of money. Obviously (sugar) daddy does not have any concerns with being exposed for who and what he is.

This will, however, end up in court and the same 'falang' mentality will grip everyone involved; how can a Thai be guilty when a falang is involved!

I believe you have the incorrect noun here, as 'driver' indicates a person who is fully conversant with the rules pertaining to driving and is competent behind the wheel. Can't think of a single word to use in its stead, but 'suicidal vehicle operator' may just fit.

In these times on thai roads, I just wonder why the guy does not have dash board videos, to support his case.

My guess is, he had but dont wanna show.

And in case he has no better "insurance", as the compulsory:

It is the fault of the gouvernment, not to make a third party insurance compulsory. And, by looking what vehicles drive on thai roads, now, with minimum 5 to10 million cover. At least.

To the chinese woman, I just can say, that other chinese are more clever. Even driving just a camry, they paying a thai national to do so. 

No comunication problems and even seen as someone, who is supporting thai families, not ony wanna have money from an "I did not do anything wrong" thai national
