Elon Musk’s Twitter takeover has been swift and rattling after months of trying to back out of the deal. It is rumoured that Musk plans to lay off 75% of Twitter’s 7,500 employees. And the ax started swinging on Friday. Stay home orders were given to thousands of employees at Twitter that may signal they’re being laid off. The man has laid the foundation for Employment Practices Liability class action. There is a way to do company wide layoffs and this was not the way. I would not want to be a shareholder because the company will be spending   large budget on defending the  employment practice claims, and then the fiduciary liability and the shareholder class actions. Musk does not appreciate that every time he shoots his mouth off, it has financial consequences.

Why? Twitter paid them 3 months termination pay with 50% on top. Of course the employees will whine and moan as if that job was their God given right to have for ever and a day. Musk claims Twitter was losing $US4 million a day! Twitter is a business, not a shareholder funded charity.

Twitter's announcement of 90 days termination pay isn't because of the goodness of the heart. Prior to the layoff notice, Musk  looked to be doing the same thing he did at Tesla when he laid off people without notice, In this case, a class action had already been filed in San Francisco court  in respect to  Twitter non compliance with US federal and  state WARN Acts.  US federal warn requires 60 day notice of layoff and some states like New York require 90 days notice. Termination packages will be  separate and in addition to the  advance notice requirement.  Many  high value employees have severance agreements such as 1-4 weeks for every year worked. Severance  will be different from the mass layoff warning requirement.

The employees were put through tremendous emotional stress because of the  manner in which Musk managed their  termination. He also disparaged the workers. If certain worker demographics dominate the layoffs, this may give rise to a class action on discrimination.  There is a way to manage a mass layoff and arrogant Musk didn't listen to the experts.

Amusing the way that all the people that smugly commented that Twitter was a private company and could ban Trump if it wanted to are now weeping and wailing in their safe spaces because there is now someone else in charge and doing things that they don't approve of.

The 60/90 day severance package is in lieu of the 60/90 notice and completely legal 

 

As for how it was handled

There is no easy way to do a mass lay-off

There really is no "right way"

 

I worked at a big company that did mass layoffs

 

A) people got laid off that day with severance, no notice 

 

B) the way they did it is they called a meeting and the peope laid off were allowed into the meeting. And us that weren't laid off were told at the door to go back to our desk

 I disagree. I don't know when your layoff occurred, but the WARN laws have been updated in the past 5 years.  The notice period specified in the respective federal and state WARN laws is not severance: It is the minimum warning notice of a planned layoff. It is a statutory requirement of notice. A statute cannot be violated at will. Many of the Twitter employees have severance provisions included in their contracts that allow for a period of pay based upon length of service. This compensation is the severance. WARN notice includes benefits, while a severance package does not necessarily include benefits. The reason why these packages are being quoted as including 90 days notice is that some states  (e..g. NY and NJ) require 90 days minimum notice. Federal and some state WARN only require 60 days notice.

Yes, an employer can provide a severance package instead of WARN notice.   A severance package may be subject (conditional) on waiving any claims under WARN. However, the severance package must include compensation for the WARN notice, which means providing financial compensation for the mandatory period in lieu of notice.  The substitution of severance alone instead of a WARN package is not allowed if the employee contract does not allow for the substitution,  or if not allowed by State law. This is key for some of the  higher value employees. We have already seen the golden termination packages for some of the Twitter C suite residents. I expect that there are hundreds of key employees who have generous compensation packages in the event that they are terminated.

It was reported that Twitter employees were told that they would be presented with severance agreements  requiring them to waive their right to sue Twitter in exchange for a payout.  This is typical of the lower end workers who must rely on statutory protections. However, if the package offered does not respect the WARN notice requirements, then the severance package can be contested.  For example, the CT WARN law requires 120 days notice/continuation of health benefits. Therefore, any  employee subject to CT employment law, won't have to accept the Twitter 90 day package.

And yes there is a right way to do a layoff. This is why there are trained HR personnel to manage the process.Nokia learnt from its 2008 debacle and did it right in 2011. Honeywell, Michelin, Ford Motor's Lincoln division and Toyota have all managed  staff redundancies well; Protecting the company brand value while maintaining the redundant employee's dignity. Musk is carrying on now as if the Twitter workers had no value, when only a short while ago, Twitter was throwing money at the workers to hire them. Musk has borrowed $4 billion to purchase Twitter. He now has debt service and a shrinking revenue stream with which to service that debt. Good luck.
